Chhattisgarh High Court भिलाई के एक शासकीय महाविद्यालय में पदस्थ महिला सहायक प्राध्यापक को बड़ी राहत दी है। हाईकोर्ट ने महिला प्राध्यापक के तबादला आदेश पर रोक लगाई है।
दुर्ग जिला के भिलाई शासकीय महाविद्यालय में पदस्थ मंजू डांडेकर का तबादला नक्सल प्रभावित जिला कांकेर के शासकीय कन्या महाविद्यालय में कर दिया गया था। मंजू डांडेकर ने अधिवक्ता अभिषेक पाण्डेय के माध्यम से हाईकोर्ट बिलासपुर में एक रिट याचिका दायर कर स्थानांतरण आदेश को चुनौती दी थी ।
याचिकाकर्ता के अधिवक्ताओं ने न्यायालय के सामने 3 जून 2015 की छत्तीसगढ़ सामान्य प्रशासन विभाग की दलील पेश करते हुए कहा है कि महिला अधिकारी-कर्मचारी व 55 वर्ष से अधिक उम्र के अधिकारियों-कर्मचारियों का अनुसूचित (नक्सल प्रभावित) जिलों में स्थानांतरण नहीं किया जाएगा।
चूंकि याचिकाकर्ता की उम्र 60 वर्ष है और वह महिला कर्मचारी का स्थानांतरण सामान्य प्रशासन विभाग की स्थानांतरण पॉलिसी का घोर उल्लंघन है,इसलिए यह स्थानांतरण अनुचित है ।
इसके साथ ही अधिवक्ता ने अपनी दलील में बताया कि याचिकाकर्ता का पुत्र रायपुर की एक निजी यूनिवर्सिटी में बीएएलएलबी की पढ़ाई कर रहा है और उसे प्रतिदिन भिलाई से रायपुर आना-जाना पड़ता है। पढ़ाई के मध्य मिड सेशन के दौरान किया गया स्थानांतरण न्यायदृष्टांत का घोर उल्लंघन है।
मामले की सुनवाई के बाद हाईकोर्ट ने महिला सहायक प्राध्यापक के स्थानांतरण आदेश पर स्टे देकर याचिकाकर्ता को बड़ी राहत दी है।

2. Challenge in this writ petition is to the impugned order of transfer dated 02.01.2023,
whereby petitioner, who is holding the post of Assistant Professor (Sociology) and posted
at Government College, Bhilai-3, district-Durg is transferred to Government Indru Kenwat
Girls College, Kanker, district-Kanker.
3. Learned counsel for petitioner would submit that transfer of petitioner is in ban
period. Petitioner is suffering from eye disease and underwent operation on 19.01.2023.
Further, son of petitioner is studying in Kalinga University and transfer is in mid-academic
session, therefore, it will be difficult for petitioner to comply with order of transfer
immediately. He also contended that petitioner is aged about 60 years as on date and
according to Clause 1.5 of Circular dated 03.06.2015 issued by State Government, female
employees above 55 years are not to be posted in Scheduled area. Till date no one is posted in place of petitioner.
4. Learned counsel for the State submits that transfer of petitioner is on administrative
exigency, not only petitioner but other Assistant Professors are also transferred and

therefore, impugned order does not call for any interference. He further submits that
petitioner if aggrieved with her transfer, she can submit representation before the
Committee constituted under Transfer Policy for redressal of her grievance, and the
Committee will decide the same in accordance with law
5. Heard learned counsel for the parties.
6. Taking into consideration facts and circumstances of the case, nature of grievance
raised by petitioner and date of order of transfer being in mid-academic session ie
02.01.2023, documents enclosed by petitioner with respect to studies of her son in
Kalinga University, at this stage I find it appropriate to dispose of this writ petition instead
of keeping it pending seeking reply from respondents, directing petitioner to submit fresh
representation before the Committee constituted under Clause-8 of the Transfer Policy,
and the Committee shall consider and decide the same within specified time.
7. Accordingly, this writ petition stands disposed of permitting petitioner to submit
detailed representation before the Committee within a period of two weeks from today,
raising all grounds as raised in writ petition. If such representation is submitted by the
petitioner, Committee shall consider and decide the same in accordance with law within
outer limit of three weeks from the date of receipt of representation.
8. As submitted by counsel for petitioner, till today no other person is posted in place
of petitioner, till decision on representation to be submitted by petitioner, effect and
operation of impugned order of transfer, so far as it relates to petitioner shall remain
9. Accordingly, writ petition stands disposed of.
